1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of clovismartialarts.com and any services provided by Guido's Martial Arts Academy ("we," "us," or "our"). By using our website, submitting a form, signing up for our 2-week trial, or enrolling in any program, you agree to these Terms. If you do not agree, do not use our services.

2. Programs and Services

We offer martial arts instruction across six tracks for students ages 3 through adult:

  • Little Ninjas / Early SKILLZ (ages 3 to 4)
  • Big Ninjas / Basic SKILLZ (ages 5 to 6)
  • Juniors Mixed Martial Arts (ages 7 to 12)
  • Juniors Brazilian Jiu-Jitsu (ages 7 to 12)
  • Teen/Adult Mixed Martial Arts (ages 13 and up)
  • Teen/Adult Brazilian Jiu-Jitsu (ages 13 and up)

Program schedules, class lengths, and instructor assignments may change. Current details are posted at the academy and on our website.

3. Two-Week Trial

Our entry offer is a 2-week unlimited trial for $59.95, which includes a complimentary Guido's t-shirt.

  • The trial provides unlimited access to age-appropriate classes during the 2-week period.
  • The trial does not auto-convert to a paid membership. No recurring charges are initiated by the trial.
  • After your trial, you are under no obligation to enroll.
  • Trial purchases are non-refundable once the first class is attended.

4. Memberships

Membership terms, pricing, billing cycles, and cancellation procedures are confirmed at enrollment. By signing a membership agreement, you accept the specific terms of that agreement, which control over any conflicting terms in this document.

5. SMS Messaging Program

Guido's Martial Arts Academy operates two separate SMS messaging programs. Participation is voluntary and requires a separate checkbox opt-in for each program on our website form. Pre-checked boxes are never used.

Program description: When you opt in, you may receive non-marketing texts about your trial booking, class schedule, account updates, and reminders. If you separately opt in, you may also receive marketing texts about special offers, discounts, new program updates, and event announcements.

By checking this box, I consent to receive marketing and promotional messages including special offers, discounts, new program updates, and event announcements from Guido's Martial Arts Academy at the phone number provided. Frequency may vary. Message & data rates may apply. Text HELP for assistance, reply STOP to opt out.

Program rules:

  • Message frequency: Varies. Most subscribers receive 2 to 8 messages per month.
  • Message and data rates may apply based on your wireless carrier and plan.
  • To opt out at any time, reply STOP to any message you receive from us. You will receive a single confirmation that your opt-out has been processed, and you will not receive additional messages from that program.
  • For help, reply HELP to any message, or contact us at (559) 477-2053 or memberservice@clovismartialarts.com.
  • Carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's transmission of the message.
  • Supported carriers: All major U.S. wireless carriers including AT&T, Verizon, T-Mobile, and their affiliates.
  • Eligibility: You must be the account holder or have authorization from the account holder for the mobile number you provide. You must be 18 or older to opt in. For minors, a parent or legal guardian must opt in on the minor's behalf.
  • Mobile information is not shared. We do not share mobile contact information or SMS opt-in consent data with third parties or affiliates for marketing or promotional purposes.

6. Liability Waiver

Martial arts training carries inherent physical risk including but not limited to bruising, sprains, strains, fractures, contusions, and concussions. All students are required to sign a liability waiver and assumption of risk document before participating in any class. The waiver is reviewed and signed at the front desk on the first visit.

By participating in any class, you acknowledge these risks and agree to the terms of the signed waiver.

7. Code of Conduct

Every student, parent, family member, and visitor is expected to:

  • Treat staff, other students, and the academy space with respect
  • Follow safety instructions from instructors at all times
  • Refrain from disruptive, threatening, or abusive behavior
  • Comply with dojo etiquette as taught by the instructors

Behavior that endangers others, disrupts the training environment, or violates this Code is grounds for termination of membership without refund.

8. Payment Terms

  • Trial payments are processed through our authorized payment processor at the time of signup.
  • Membership payments are billed according to the schedule in your enrollment agreement.
  • Failed payments may result in suspension of access until the account is brought current.
  • Refunds for memberships, if applicable, are governed by your enrollment agreement.

9. Intellectual Property

All content on clovismartialarts.com, including text, images, video, logos, curriculum names (Little Ninjas, Big Ninjas, Early SKILLZ, Basic SKILLZ), and program structures, is the property of Guido's Martial Arts Academy or its licensors. You may not copy, reproduce, or use this content without written permission.

10. Limitation of Liability

To the maximum extent permitted by California law, Guido's Martial Arts Academy is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website, services, or facility. Our total liability for any claim arising from our services is limited to the amount you paid us in the 12 months before the claim arose.

This section does not limit liability for gross negligence, willful misconduct, or any liability that cannot be limited under California law.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of our services will be resolved in the state or federal courts located in Fresno County, California, and you consent to the personal jurisdiction of those courts.

Before filing any lawsuit, you agree to first attempt to resolve the dispute by contacting us in writing at memberservice@clovismartialarts.com. We will make a good-faith effort to resolve the matter within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be posted on our website. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
